All content on storessurfboards.com, including text, graphics, logos, and product designs, is the property of Wind Rush Shop and protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

2. Products and Services

2.1 Product Descriptions

We take care to accurately describe our kiteboarding boards, hydrofoils, harnesses, and accessories. However, slight variations in color or design may occur. Product images are for illustrative purposes only.

2.2 Product Availability

All products are subject to availability. We reserve the right to limit quantities and discontinue products without notice. Custom items from our Build A Bar Workshop are made-to-order and may have longer production times.

2.3 Safety Notice

Kiteboarding and hydrofoiling involve inherent risks. Our HitchSafe systems and other safety equipment should be properly maintained and used according to manufacturer guidelines. Wind Rush Shop is not liable for injuries resulting from improper use of our products.

3. Orders and Payments

3.1 Order Process

When you place an order, you’re making an offer to purchase which we may accept or decline. Order confirmation emails do not constitute acceptance. We process orders within 1-2 business days (excluding weekends/holidays).

3.2 Pricing

All prices are in USD. We reserve the right to adjust prices due to market conditions, though we’ll honor the price at time of order confirmation. Additional customs fees may apply for international orders.

3.3 Payment Methods

We accept Visa, MasterCard, JCB, and PayPal. You represent that you have authorization to use your chosen payment method. Failed payments may result in order cancellation.

3.4 Shipping

We offer:

• Standard Shipping ($12.95): Via DHL/FedEx, delivered in 10-15 business days after shipping
• Free Shipping: For orders over $50 via EMS, delivered in 15-25 business days after shipping

We currently don’t ship to some remote areas and parts of Asia. Delivery times may vary due to customs processing.

4. Returns and Refunds

4.1 Return Policy

We accept returns within 15 days of delivery for unused items in original packaging with all tags. To initiate a return:

1. Email [email protected] within 15 days with your order details
2. Wait for Return Merchandise Authorization (RMA)
3. Ship items securely with RMA included

4.2 Non-Returnable Items

For safety reasons, we cannot accept returns on:

• Custom products from Build A Bar Workshop
• Opened/used harness accessories
• Used HitchSafe systems
• Any products that have been used, damaged, or altered

4.3 Refunds

Refunds are processed within 3-5 business days after we receive your return. Original shipping fees are non-refundable unless the return is due to our error. Refunds will be issued to your original payment method.

5. User Responsibilities

5.1 Account Security

If you create an account, you’re responsible for maintaining confidentiality of your login information and for all activities under your account.

5.2 Accurate Information

You must provide current, complete, and accurate information for all purchases. Incorrect shipping information may result in delayed or lost shipments.

5.3 Prohibited Conduct

You agree not to:

• Use our site for any illegal purpose
• Attempt to gain unauthorized access to our systems
• Interfere with the site’s operation
• Submit false return requests

6. Liability Limitations

6.1 Product Use

Wind Rush Shop is not liable for injuries or damages resulting from improper use of our products. Kiteboarding and hydrofoiling are inherently risky activities that require proper training and safety precautions.

6.2 Website Availability

We strive to keep our site available but aren’t liable for temporary outages or technical issues beyond our control.

6.3 Limitation of Liability

To the maximum extent permitted by law, Wind Rush Shop’s liability is limited to the purchase price of the product in question. We’re not liable for incidental or consequential damages.

7. General Provisions

7.1 Changes to Terms

We may update these terms periodically. The current version will always be posted on our site with the effective date.

7.2 Governing Law

These terms are governed by the laws of the State of Ohio, USA. Any disputes shall be resolved in courts located in Franklin County, Ohio.
